Mediation, Collaborative Divorce, and Consultation

Recently named Family Lawyer of the Year for the Springfield area by Best Lawyers in America, Merry Nasser has practiced divorce and family law for over thirty-six years. Her practice now is devoted to collaborative divorce and mediation.

Mediation

Mediation is a process in which Merry acts as a neutral facilitator to help parties resolve issues and finalize a fair Agreement. About half of Merry’s mediation practice is comprised of cases in which she meets directly with both parties, helps them work through their issues, and then provides them with the written Agreement necessary to file a no-fault divorce.

The other half of her mediation practice is comprised of attorney-assisted cases in which she serves as a neutral facilitator for two attorneys and their clients who are having difficulty resolving issues, but who would like to avoid the costs and emotional strain of litigation.

Merry mediates in divorce and post-divorce situations, pre-marital and post-marital agreements, and custody matters.

Collaborative divorce

Collaborative divorce is a process in which clients choose collaborative divorce attorneys who are committed to negotiating a settlement outside of the courtroom and finalizing an uncontested divorce. Negotiations are conducted primarily in meetings with clients and attorneys in the room. Merry’s experience is that the results she obtains for her clients in this process are comparable to those obtained through a litigated divorce, with far less negative impact on the family.

Consultation and representation in family law matters

Merry continues to consult with divorce clients who are working through their divorce in a mediation process with another mediator, or are planning to represent themselves in a divorce or other family law matter. She also negotiates pre-marital and post-marital agreements.
